Many of the transactions that our real estate attorneys are involved with also require federal, state and local land use permits and approvals. Our attorneys, many of whom have extensive prior experience as state agency and municipal counsel, are experts in shepherding a project through the often bewildering maze of land use permitting including zoning, site plan review, subdivision control, Title V, wetlands and hazardous waste. These attorneys, either working alone or in concert with a client’s other consultants, facilitate the preparation of applications, presentations at public hearings, opinion letters and legal memoranda, and frequently appear as a client’s spokesperson at Board of Appeal, Planning Board, Board of Health and Conservation Commission hearings.
In addition, our real estate attorneys represent clients in real estate and land use related litigation and alternative dispute resolution. Such disputes often concern upholding or challenging permits, resolving title and other possessory right issues, landlord-tenant relations and property valuations.The attorneys appear at administrative hearings, at trial and appellate levels of the federal and state courts, and before mediators and arbitrators. Of course, the expertise and resources of the firm’s Trial/Litigation Group are always available to assist in any litigation or dispute resolution matter.
